Acceptance of These Terms
These Terms of Service ("Terms") are an agreement between you and TranscriptMagic ("we", "our", or "us"). They govern your use of our website, our iOS app, our Chrome extensions, our API, and any other service we provide (together, the "Service").
By creating an account, purchasing credits or a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. If you use the Service on behalf of a company or other organization, you confirm that you have the authority to bind that organization to these Terms.
Description of the Service
TranscriptMagic generates text transcripts from media you submit. Depending on the plan and platform you use, this includes:
- Transcripts from social video URLs — YouTube, TikTok, Instagram, Facebook, X (Twitter), LinkedIn, and Rumble
- Transcripts from podcast episodes, including Spotify and Apple Podcasts
- Transcripts from audio and video files you upload directly
- AI features built on top of a transcript — summaries, translation, repurposing into other formats, and chat
- Exports in formats such as plain text, SRT, and VTT
We may add, change, or remove features at any time. We may also set technical limits — such as file size, media length, request rate, or the number of concurrent jobs — and adjust them as needed to keep the Service reliable.
Accounts and Account Security
Some parts of the Service can be used without an account. For everything else you sign in with Google or, in our iOS app, with Apple. You are responsible for the security of the account you use to sign in and for all activity that happens under your account.
- Keep your sign-in credentials and session tokens confidential
- Do not share your account with others or resell access to it
- Provide accurate account and billing information and keep it current
- Tell us promptly at hello@transcriptmagic.com if you believe your account has been compromised
One person or organization may not create multiple accounts to avoid usage limits or to obtain additional free credits.
Credits, Plans, and Billing
How Credits Work
The Service runs on credits. Each transcript, summary, translation, or other AI action consumes credits from your balance, at the rate shown on the pricing page at the time of use. Longer media — such as podcast episodes and uploaded files — consumes more credits than a single short video. Credits have no cash value, cannot be exchanged for cash, and are not transferable between accounts.
Free Plan
The Free plan includes 3 credits per month at no charge. Free credits refresh monthly and are intended for personal evaluation of the Service. We may change the size of the free allowance at any time.
Paid Plans
Paid plans (currently Plus and Pro, with several Pro credit tiers) are subscriptions billed monthly or annually in advance. Current prices, credit allowances, and rollover rules are listed on our pricing page, which is incorporated into these Terms by reference. All prices are in U.S. dollars and exclude any taxes we are required to collect.
Payment Processing
Payments made on our website are processed by Polar (our merchant of record). Some older accounts were billed through Lemon Squeezy. Subscriptions purchased in our iOS app are processed by Apple. We do not receive or store your full payment card details. Your purchase is also subject to the payment processor's own terms.
Auto-Renewal and Cancellation
Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from your dashboard (for web purchases) or in your Apple Account settings (for App Store purchases). Cancellation takes effect at the end of the current billing period — you keep access and any remaining credits until then, and you are not charged again after that.
Refunds
Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused credits, or downgrades. If something goes wrong — a failed job, a duplicate charge, or a transcript we could not deliver — email hello@transcriptmagic.com and we will make it right, typically by restoring credits or issuing a refund at our discretion. Purchases made through the App Store are refunded by Apple under Apple's policies, not by us.
Price Changes and Failed Payments
We may change prices. For subscriptions, we will give you notice before a price change takes effect on your renewal, and you may cancel before then if you do not agree. If a payment fails, we may suspend paid features until payment succeeds.
Subscriptions Purchased Through the Apple App Store
If you purchase an auto-renewing subscription inside our iOS app, the following terms apply in addition to the billing terms above.
- The title, duration, and price of the subscription — including the price per period — are shown on the purchase screen before you confirm.
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
- You can manage your subscription and turn off auto-renewal at any time in your Account Settings on your device after purchase. Turning off auto-renew is the only way to stop an App Store subscription from renewing — deleting the app does not cancel it.
- If a free trial is offered, any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable.
- Refunds for App Store purchases are handled by Apple in accordance with Apple's policies. We cannot issue refunds for purchases made through Apple.
These Terms are between you and TranscriptMagic only, not with Apple. Apple is not responsible for the Service or its content, and Apple has no obligation to provide maintenance or support for the Service. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
Acceptable Use
Rights to the Content You Submit
You must have the right to transcribe, translate, and otherwise process every URL, file, or episode you submit. That means you own the content, you have permission from the rights holder, or your use is otherwise permitted by law. You are solely responsible for the content you submit and for how you use the output.
Prohibited Conduct
You agree not to use the Service to:
- Infringe copyright, trademark, privacy, publicity, or any other rights
- Process private, confidential, or unlawfully obtained recordings
- Violate any law, regulation, or the terms of the platform hosting the content
- Create or distribute harassing, defamatory, deceptive, or abusive material
- Attempt to identify, surveil, or profile individuals without their consent
- Resell, sublicense, or redistribute the Service or bulk output as a competing product
- Scrape, crawl, or systematically harvest the Service outside of our documented API
- Circumvent credit limits, rate limits, paywalls, authentication, or device-based free-tier tracking
- Probe, disrupt, overload, or reverse engineer the Service or its underlying infrastructure
- Upload malware or anything designed to interfere with the Service or other users
We apply rate limits and abuse protections to keep the Service available for everyone. Excessive or automated use that degrades the Service for others may be throttled or blocked, with or without notice.
Intellectual Property
Our Rights
The Service — including the website, apps, extensions, API, software, design, and the TranscriptMagic name and logo — is owned by us and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.
Your Content and Your Output
You retain all rights to the content you submit. As between you and us, you own the transcripts and AI output generated from your content, subject to any rights the original rights holder may have in the underlying material. You grant us a limited license to process, store, and transmit your content solely to operate and improve the Service and to provide features such as transcript history. We do not sell your content, and we do not claim ownership of it.
Copyright Complaints
If you believe content processed through the Service infringes your copyright, contact us at hello@transcriptmagic.com with enough detail to identify the material and your rights in it. We will respond to valid notices and may remove content and terminate repeat infringers.
Third-Party Content and Platforms
TranscriptMagic is an independent service. We are not affiliated with, sponsored by, or endorsed by YouTube, Google, TikTok, Instagram, Meta, X (Twitter), LinkedIn, Rumble, Apple, or Spotify. All product names, logos, and trademarks belong to their respective owners and are used only to describe what the Service supports.
Your use of those platforms remains subject to their own terms. We do not control what those platforms publish, how they change their APIs or interfaces, or whether a specific video, episode, or account remains available. A platform change may cause part of the Service to stop working, temporarily or permanently, and that is outside our control.
AI Output and Accuracy
Transcripts, summaries, translations, chat responses, and other AI output are produced by automated systems and may contain errors, omissions, mistranslations, or fabricated details. Accuracy varies with audio quality, accents, background noise, technical vocabulary, and the source platform's own captions.
The Service is provided for general informational and productivity purposes. It is not legal, medical, financial, or other professional advice, and it is not suitable as the sole record for legal, medical, compliance, or safety-critical purposes. Review and verify output before you rely on it, publish it, or make decisions based on it.
API Terms and API Key Security
We offer a public API, documented at docs.transcriptmagic.com. API use is governed by these Terms plus the following:
- Your API key (
sk_live_…) is a secret credential. Store it server-side, never commit it to a public repository, and never embed it in client-side code, a mobile app binary, or a browser extension. - You are responsible for all usage and all credits consumed under your API key, including usage by anyone who obtains your key.
- Rotate your key immediately, and notify us, if you believe it has been exposed. We may revoke a key we reasonably believe has been compromised or abused.
- API calls consume credits from the same balance as the rest of the Service and are subject to documented rate limits.
- Do not use the API to build a product that substantially replicates or resells the Service to third parties without a written agreement with us.
- We may change, deprecate, or version API endpoints. We will make reasonable efforts to give notice of breaking changes.
Termination and Suspension
You may stop using the Service at any time and may cancel a subscription or request deletion of your account by contacting us. We may suspend or terminate your access, with or without notice, if you breach these Terms, if your use creates legal risk or harm to us or other users, if payment fails, or if we are required to do so by law.
If we terminate your account for a reason other than your breach, we will refund any prepaid, unused portion of your current subscription period. On termination, your right to use the Service ends, remaining credits are forfeited, and we may delete your stored transcripts. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that any particular video, episode, or file can be processed, or that output will be accurate or complete.
Limitation of Liability
To the maximum extent permitted by law, TranscriptMagic and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless TranscriptMagic and its owners, employees, and suppliers from any claims, damages, liabilities, losses, and reasonable legal fees arising out of or related to: the content you submit to the Service; your use of transcripts or AI output; your breach of these Terms; or your violation of any law or of any third party's rights.
Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version on this page and update the "Last updated" date. For material changes, we will make a reasonable effort to notify you — for example by email or an in-app notice — before they take effect. Continuing to use the Service after the changes take effect means you accept the revised Terms.
Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan and the United States, without regard to conflict-of-law rules. You and we agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Michigan, and both parties consent to the jurisdiction of those courts. Nothing here prevents either party from seeking injunctive relief where appropriate, and if you are a consumer, this section does not deprive you of any protection you have under the mandatory law of your place of residence.
General
These Terms, together with our Privacy Policy and the pricing page, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
